Couple asserts husband's mesothelioma diagnosis caused by more than three decades of asbestos exposure

GALVESTON – A Navy veteran and his wife are pursuing legal action after he reportedly was diagnosed with mesothelioma last year.

Recent Galveston County District Court records show that Charles and Kaye Barker filed a lawsuit against BP Corp. North America, Inc. and several others in the 212th District Court on Mar. 7.

In the 9-page original petition, the Barkers pin Charles Barker’s illness on his service aboard the USS Delta AR-9 and USS Shelton DD-790 nearly 50 years ago and his course of employment with American Oil Co. “from approximately 1979 to 2012.”

“Prior to 1986 he was exposed to asbestos dust and/or fibers,” the suit says. As a result of his exposure to asbestos dust and/or fibers while in the Navy and working for Amoco Oil, Mr. Barker developed mesothelioma and/or lung cancer.”

Consequently, the plaintiffs seek unspecified monetary damages and a jury trial.

They are represented by Ian P. Cloud of the law firm Robins Cloud LLP in Houston.
