Consumer accuses collection agency of harassment for payment

SHERMAN —A Mesquite woman is suing a collection agency, alleging she was harassed after receiving medical care.

Mary K. Cornelius filed a complaint March 18 in the Sherman Division of the Eastern District of Texas against Elevate Recoveries LLC, alleging violation of the Fair Debt Collection Practices Act, violation of the Telephone Consumer Protection Act and violation of the Texas Debt Collection Practices Act.

According to the complaint. Cornelius was injured in 2016 when she slammed her finger in door. She says she received emergency medical treatment from City Hospital at White Rick and was financially obligated to the hospital. 

In May 2018, the suit says, the plaintiff began to receive calls from Elevate Recoveries to collect the money owed. The plaintiff says she was repeatedly called by Elevate, which eventually threatened a civil lawsuit when Cornelius had not paid the full balance owed.

The plaintiff seeks trial by jury, damages of $500 for each violation and treble damages of $1,500 for each violation. She is represented by attorneys Joseph S. Davidson and Mohammed O. Badwan of Sulaiman Law Group LLC in Lombard.
