Lifeguard files personal injury suit against LA Fitness

HOUSTON – Alleging that a large chunk of sheetrock fell on him while he was working as a lifeguard at a local LA Fitness, Harris County resident Jacolby Moore has pursued legal action.

Moore filed a lawsuit against the Irvine, Calif.-based gym chain on Mar. 19 in the Harris County 334th District Court.

The 7-page suit says that there was a leaky AC unit in Moore’s work area. LA Fitness purportedly knew about the condition in question, but “ignored the reports and failed to take remedial action.”

“As a result, leaking water eventually caused the sheetrock to become unstable and a large chunk of sheetrock crashed down on the plaintiff’s head and right shoulder,” the original petition says.

The plaintiff seeks unspecified monetary damages and a jury trial.

He is represented by Kenneth R. Baird of The Baird Law Firm in Houston.
