Welder alleges Colorado company failed to pay overtime

HOUSTON — A Colroado man is filing a class action lawsuit against his employer, alleging that he was not paid for overtime hours worked.

Beau Kelley, individually and on behalf of all others similarly situated, filed a complaint March 28 in the Houston Division of the Southern District of Texas against Alpine Site Services Inc., alleging violation of overtime wage payment, violation of the Fair Labor Standards Act and failure to maintain accurate records.

According to the complaint, Kelley was employed as a welder for the defendant for jobs in Texas, Louisiana, New Jersey, Ohio and Pennsylvania for three years. Kelley alleges he was paid on an hourly basis. Despite regularly working in excess of 40 hours per week, he was not paid for the overtime hours worked as requited by the FLSA, the suit says. 

The plaintiff also alleges Alpine Site kept inaccurate records regarding the plaintiff's hours worked.

Kelley seeks interest, all unpaid overtime compensation and liquidated damages, attorney fees and court costs. He is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
