Employee alleges Kansas City Railway's Company malfunctioning locomotive caused injuries

SHERMAN — A railroad worker is suing a railway company, alleging he was injured when a locomotive malfunctioned and derailed.

Fronzell M. Anderson II filed a complaint April 12 in the Sherman Division of the Eastern District of Texas against The Kansas City Southern Railway Company, alleging negligence and violation of federal safety statutes and regulations.

According to the complaint, Anderson was riding in a KCSR locomotive on Sept. 21, 2018. The suit says the locomotive dreailed, shook and jolted, causing Anderson to sustain injuries to his head, back, left wrist, left hip, right thumb and other body parts.

The plaintiff says he has sustained pain and suffering, lost earnings and benefits and medical expenses.

Anderson seeks a juiry trial, damages in excess of $75,000, interest, court costs and other just relief. He is represented by attorneys Bristol Baxley of Rome, Arata & Baxley LLC in Pearland, and by J. Michael Young of Sanders, Motley, Young & Gallardo in Sherman.
