Worker alleges negligence after falling through open hole on offshore oil platform

GALVESTON — A Louisiana man is suing operators of an offshore oil platform worksite, alleging he was injured when he fell through an open hole.

Melvin Nicholas filed a complaint April 16 in the Galveston Division of the Southern District of Texas against Kinetica Energy Express LLC and Kinetic Deepwater Express LLC, alleging negligence and gross negligence.

According to the complaint, Nicholas was working on an offshore platform at Vermilion Block 397 in the Gulf of Mexico. The suit says Nichoals was seriously injured when he fell into an open hole and onto the deck below.

The plaintiff alleges the defendants failed to ensure that the premises was free from hazards and failed to ensure the safety of workers.

Nicholas seeks trial by jury, damages, attorney fees, court costs and all other just and appropriate relief. He is represented by attorneys Marcus R. Spagnoletti and Eric J. Rhine of Spagnoletti Law Firm in Houston.
