Couple seeks right to occupy Friendswood property in lease dispute

GALVESTON – A Galveston County couple alleges a Harris County resident falsely claimed they were in default of their lease and are seeking judgment that they have a right to occupy the property.

Scott and Lauren Butaud filed a complaint on May 6 in the Galveston County District Court against Shelly Thornhill seeking declaratory judgment.

The suit states the plaintiffs and the defendant entered into two residential leases with the option to purchase a residence in Friendswood. The plaintiffs allege they have paid $168,000 to occupy the property through June 30. 

The suit states the defendant contacted the plaintiffs in April and stated they were in default of their second contract and demanded that they vacate by May 9. The plaintiffs allege they are not in default and are seeking a judgment that they have the right to occupy the property.

The plaintiffs are seeking relief of less than $1 million, attorneys' fees, court costs and other relief deemed fit. They are represented by Jared G. LeBlanc and Meghan K. Flanery of Gordon, Arata, Montgomery, Barnett, McCollam, Duplantis & Eagan LLC in Houston.
