Patient alleges medical team did not diagnose serious condition in timely manner

HOUSTON — A patient is suing a Houston medical team, alleging he was not properly diagnosed with a medical condition in a timely manner.

Marc Roberts filed a complaint May 21 in Harris County District Court against Kelsey-Seybold Medical Group PLLC, doing business as Kelsey-Seybold Clinic, Dr. Oliver C. Wu, Elizabeth Pena, Dr. Dom Guiying Hu, Dr. Huiqing Yang, Dr. Marianna Karpinos, Dr. Amy L. Turner D.C., and Dr. Ahmed I. Sewielam, alleging negligence.

According to the complaint, Roberts came to the Kelsey-Seybld clinic May 12, 2017 with pain and numbness in his right foot and leg. On May 30, 2017, the suit says, an EMG diagnosed Roberts with mild right L5 radiculopathy, and on June 2, 2017, he was seen by Yang who did a physical exam but failed to include a vascular assessment. 

The suit alleges on July 8, 2017, Wu also failed to order a vascular workup despite Roberts' complaints of worsening leg pain. On July 12, 2017, Roberts says he was seen by Yang because he could not walk but the defendant again did not order a vascular workup. 

On July 17, 2017, the suit says, Roberts was examnined by Pena about leg pain and his leg being cold and his foot being pale, and on July 18, 2017, he saw Turner, and Hu with similar complaints, but neither doctor ordered a vascular workup. 

On Aug. 23, 2017, the plaintiff says he complained of more severe symptoms but the doctor still failed to order a workup. The plaintiff allegedly was seen by Wu on Aug. 25, 2017, but a screen for blood clots was not performed until Sept. 14 2017. 

The plaintiff says he had similarly inconclusive visits Sept. 1 and Sept. 12, 2017, and on Sept. 14, 2017 the exam showed he had no blood flow below his right femoral artery. The plaintiff was then diagnosed with thrombosis, and ischemia, the suit says.

The plaintiff alleges the defendants' negligence led to physical pain, disfigurmement, mental anguish and loss of earning capacity.

Roberts seeks trial by jury, interest, court costs and all other just relief. He is represented by attorneys Tommy R. Hastings and Gregory L. Feste of Hasting Law Firm PC in The Woodlands.
