Couple alleges Kohl's negligence led to silverware falling on wife

HOUSTON — A Chambers County couple is suing Kohl's, alleging that the wife was injured when boxes of silverware fell on her on the defendant's store in Baytown.

Ludivina Cardenas and Bibian Cardenas filed a complaint May 22 in Harris County District Court against Kohl's Department Stores Inc., doing business as Kohl's Baytown, alleging negligence.

According to the complaint the Cardenases were at the Kohl's, at 6520 Garth Road, Baytown, on May 26, 2017. The suit says Ludivina Cardenas lifted a box of silverware to see a platter and the other boxes of nearby silverware fell on her foot.

The plaintiffs say this caused Ludivina Cardinals to acute injuries and lacerations to her right foot and ankle and other parts of her body. The suit says she bled profusely and required EMS ambulance transport to the hospital.

The plaintiffs allege Kohl's failed to inspect the premises and failed to maintain a safe place for customers.

The Cardnesas seek trial by jury, interest, costs of court and all other just relief. They are represented by attorney Andrew Sher of The Sher Law Firm PLLC in Houston.
