Longview consumer alleges Merchants Credit Guide failed to mark account as disputed on credit report

LUFKIN – A Longview woman alleges an inaccurate account listed on her credit report has caused credit denials.

Tamara Hand filed a complaint on May 22 in the Lufkin Division of the Eastern District of Texas against Merchants Credit Guide Co. and Trans Union Corp. alleging violation of the Fair Debt Collection Practices Act and the Fair Credit Reporting Act.

The suit states Merchants Credit Guide allegedly is attempting to collect a debt from the plaintiff and reported a collection account on the plaintiff's credit report with Trans Union. 

The suit states the plaintiff's representative sent a letter to dispute the account on Oct. 2, 2018, and on Dec. 20, 2018, the plaintiff received an updated credit file from Trans Union. The plaintiff alleges the defendants failed to update the account information and mark it as disputed. The plaintiff alleges she has been harmed due to credit denials she blames on the false reporting.

The plaintiff is seeking a trial by jury, relief deemed fit, attorneys' fees, court costs, punitive damages, actual damages. The plaintiff is represented by Gregory S. Motil, Joel S. Halvorsen and Gregory M. Klote of Halvorsen Klote in St. Louis, Missouri.
