HOUSTON – A Tomball woman alleges the amount of an alleged debt was inflated by more than $100.
Neisha Houston filed a complaint on May 29 in the Houston Division of the Southern District of Texas against Hunter Warfield Inc. and The Abbey on Lake Wyndermere alleging violation of the Fair Debt Collection Practices Act and violation of the Texas Debt Collection Act.
The suit states Hunter Warfield is attempting to collect an alleged debt from the plaintiff relating to a lease for an apartment at The Abbey on Lake Wyndermere.
The plaintiff alleges she owes either nothing to the defendants or $82.13 at most, but the defendants are seeking an alleged balance of $246. The plaintiff alleges Hunter Warfield falsely represented the amount of the debt and The Abbey on Lake Wyndermere attempted to collect charges, fees or expenses not authorized by an agreement.
The plaintiff is seeking trial by jury, $1,000 in statutory damages, damages provided under TDCA, attorneys' fees, litigation expenses, costs of the suit, injunctive relief and other relief deemed fit. The plaintiff is represented by Shawn Jaffer of the Shawn Jaffer Law Firm PLLC in Frisco.
