HOUSTON — A landscaper is suing his employer, alleging that he was not paid for all the overtime hours he worked.

Jose Carrillo filed a complaint June 4 in the Houston Division of the Southern District of Texas against Terra Tex Commercial Grounds Maintenance Inc., alleging violation of the Fair Labor Standards Act.

Carrillo says he worked as a landscaper for Terra Tex from 2007 to April 25, 2019. The plaintiff says he regularly worked in excess of 40 hours a week and was not an exempt employee. The defendant, however, allegedly failed to pay Carrillo for overtime hours worked as required by the FLSA.

Carrillo seeks trial by jury, overtime wages owed, liquidated damages, attorney fees and other just and equitable relief. He is represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
