Police officer accused of trying to kill man

SHERMAN — A Fannin County man is suing a Tom Bean police officer, alleging he threatened to kill the plaintiff.

Barry Koonce filed a complaint June 10 in the Sherman Division of the Eastern District of Texas against the city of Tom Bean and Zach Smith, alleging negligence and deprivation of constitutional rights.

According to the complaint Koonce was driving on state Highway 11 on Feb. 1, and was driving at the speed limit. The suit says Koonce began to be followed by a Tom Bean police department vehicle. 

The plaintiff says he was pulled over by Smith and told to wait while the police officer examined his license. Koonce said he was threatened by Smith who allegedly said he would shoot Koonce and leave him bleeding on the highway if he ever again got out of his vehicle in Tom Bean again.

Koonce seeks trial by jury, interest, damages, costs of the suit, attorney fees and other just relief. He is represented by attorney Ronald R. Huff  of Sherman.
