Driver alleges he was not paid appropriately for overtime hours

HOUSTON — A route driver is suing his employer, alleging he was not paid appropriately for overtime hours worked.

Juan Antonio Garcia, individually and on behalf of all similarly situated persons, filed a class action complaint June 12 in the Houston Division of the Southern District of Texas against Boze Enterprises II LLC and Michael S. Boze, alleging violation of the Fair Labor Standards Act.

The plaintiff alleges he was employed by Boze as a line driver from 2012 to May 20, 2019. The suit states Garcia regularly worked in excess of 40 hours a week while employed by Boze but was not paid the appropriate overtime premium he was owed as required by the FLSA.

Garcia seeks trial by jury, attorney fees, unpaid overtime wages and all other just and equitable relief. He is represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
