Elderly couple alleges air conditioning unit did not work properly

HOUSTON — An elderly Katy couple is suing an air conditioner installation company, alleging the unit that was installed did not work as represented. 

Dorris and David Pascal, a couple in their 80s, filed a complaint June 17 in Harris County District Court against John Moore Services Inc., alleging violation of the Texas Deceptive Trade Practices Act, breach of contract, negligent misrepresentation and fraud.

The Pacals allege they contacted John Moore Services seeking an air conditioning unit for their Katy home that would help with David Pascal's medical issues that included asthma. The defendant allegedly represented that a larger-sized unit would alleviate his medical issues but the system installed has not helped. 

The plaintiffs allege John Moore Services has failed to fix the unit without additional payment even though the unit's repairs were under warranty. The plaintiffs say they also noticed that there were several issues with the unit but the defendant has failed to repair the unit correctly.

The Pascals seek consequential damages, exemplary damages, attorney fees, interest, court costs and all other just relief. They are represented by attorneys Matthew A. Kornhauser and James V. Nguyen of Hoover Slovacek LLP in Houston.
