Galveston car dealership alleges Mullen Asphalt failed to pay subcontractors, breached contract

GALVESTON — A Galveston car dealership is suing a pavement company, alleging the defendant failed to pay its subcontractors, leaving the plainitff on the hook for payment.

Classic Galveston Chevrolet and Toyota filed a complaint June 26 in Galveston County District Court against Mullen Asphalt Paving, alleging breach of contract and unjust enrichment.

According to the complaint, Classic Galveston paid Mullen Asphalt to complete a project, which included removing debris and installing new pavement. The plaintiff, the suit says, has paid the defendant $53,250 but the defendant has failed to pay their subcontractors a total of $33,451.65, which makes Classic Galveston unfairly responsible for the amount of the lien even though the plaintiff has already paid the defendant in full.

Classic Galveston Chevrolet and Toyota seeks actual damages, monetary relief of less than $100,000, attorney fees, interest and all other just relief. It is represented by attorneys Fred D. Raschke and Elizabeth McDonnell of Mills Shirley LLP in Galveston.
