Customer alleges Take 5 Oil Change negligence caused her to fall through opening in ground

HOUSTON — A Harris County woman is suing an auto repair business, alleging she was caused to fall through an opening in the ground at the defendant's facility in Pasadena.

Zayra Hernandez filed a complaint July 2 in the Harris County District Court against Take 5 Oil Change LLC, alleging liability and negligence.

According to the complaint, Hernandez was a customer at Take 5 Oil Change on June 12, at 6439 Fairmont Parkway, Pasadena. The suit alleges Hernandez was sitting in her vehicle waiting for a Take 5 employee to service her vehicle. The employee allegedly called the plaintiff out of the vehicle and while she was walking around the vehicle she fell through an opening meant to allow service technicians to access the undercarriage of vehicles.

The suit alleges Hernandez sustained pain and suffering, mental anguish, impairment and medical expenses.

Hernandez seeks interest, court costs, monetary relief between $100,000 and $200,000, a maximum recovery of $70,000 and all other just relief. She is represented by attorneys David K. Mestemaker, Norman Straub and Jonathan B. Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
