Shivan alleges construction business partner breached contract

GALVESTON — A Galveston County corporation is suing a construction business partner, alleging it breached a contract.

Shivan Inc., filed a complaint July 11 in Galveston County District Court against AKIB Construction Inc., and Manzoor A. Memon, individually, alleging invalid and fraudulent lien and breach of contract.

According to the complaint, Shivan purchased a property at 2315 Maxwell St. La Marque on Dec. 30, 2016. The suit alleges AKIB was required to supervise all construction work and assist in getting the occupancy permit upon completion of the project for which the plaintiff would pay the defendant a 10% builder's fee of the total construction costs. 

The defendant allegedly has failed to perform its scope of the work and has failed to pay its material suppliers as required by the contract. The defendant has also been taking an 11% builder's fee, which is more than listed in the contract, the suit states.

Shivan seeks seeks attorney fees, statutory damages, court costs, interest and other just relief. It is represented by attorney Matthew S. Cire of Andrews Myers PC in Houston.
