Class action alleges collection letter was misleading

HOUSTON — A Spring man is suing a collection agency, alleging he was misled about the balance he owed on a debt.

Paul Conway, individually and on behalf on all others similarly situated, filed a class action complaint July 15 in the Houston Division of the Southern District of Texas against Perfection Collection LLC, and John Does 1-25, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, Conway was sent a collection letter by Perfect Collection on July 18, 2018. The letter allegedly stated the plaintiff owed the balance of $870.43, but said a payment of $962.83 was due. 

The plaintiff argues he had no way of knowing which of the two amounts was owed. Conway says he has incurred informational injury as he could not ascertain the amount he owed, making the defendant guilty of deceptive, misleading and unfair debt collection practices.

Conway seeks trial by jury, attorney fees, expenses, interest and all other just and proper relief. He is represented by attorneys Shawn Jaffer of Shawn Jaffer Law Firm PLLC in Frisco and by Yaakov Saks of Stein Saks PLLC in Hackensack, New Jersey.
