Galveston County couple alleges Kemah neighbor failed to prevent pit bull attack

GALVESTON — A Galveston couple is suing a Kemah neighbor, alleging the defendant's pit bull attacked one of the plaintiffs.

Lloyd Hendry and Michelle Rushing filed a complaint July 16 in Galveston County District Court against Martin Schneider, alleging negligence, injury due to a dangerous animal and breach of contract.

According to the complaint, Hendry, was walking his Yorkshire terrier Feb. 19, in his neighborhood around 422 Lakeside Drive, Kemah. The suit alleges Hendry saw that Schneider was approaching with his pit bull terrier and the pit bull broke loose and began to attack the plaintiff, biting his leg. 

The lawsuit states Hendry had to be transported to the Memorial Hermann emergency room due to the attack and has since had to have a number of surgeries and follow-up medical visits with costs exceeding $70,000, plus lost wages. 

The suit alleges Schneider agreed verbally to pay Hendry's expenses and the plaintiff received a check for $2,500 but the amount outstanding was $2,773.42. 

The defendant allegedly has done nothing to prevent another incident from occurring involving the pit bull, as he continues to walk the dog without a harness or muzzle

Hendry and Rushing seek between $200,000 and $1 million, trial by jury, interest, attorney fees, court costs and all other just relief. They are represented by Andrew J. Mytelka and Victoria S. Rutherford of Greer, Herz & Adams LLP in Galveston.
