Employee alleges Abry Brothers failed to pay for overtime

HOUSTON — A laborer is suing his employer, alleging he was not paid for overtime hours worked.

Jose Alejandro Saravia, individually and on behalf of all similarly situated persons, filed a class action complaint July 22 in the Houston Division of the Southern District of Texas against Abry Brothers (Houston) LLC and Mark Dimitrijevic, alleging violation of the Fair Labor Standards Act.

According to the complaint, Saravia was employed by Abry Brothers as a laborer between September 2017 and April 8, 2019 and was paid on a day-rate basis. The plaintiff alleges he often worked more than 40 hours per week was never paid overtime at 1 1/2 times his hourly wages as required by the FLSA.

Saravia seeks trial by jury, judgment, unpaid wages, liquidated damages, attorney fees, court costs and all other just and equitable relief. She is represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
