Home Depot customer alleges he was struck by falling toilet

HOUSTON — A Houston customer is suing Home Depot, alleging that he was struck by a toilet that fell off a shelf.

Kevin Calvin filed a complaint on July 20 in the Harris County District Court against Home Depot U.S.A. Inc., alleging negligence.

According to the complaint, Calvin was a guest at the Home Depot, 6810 Gulf Freeway, Houston, on July 25, 2017. Calvin alleges he was walking down the toilet aisle and while standing in front of a section of toilets stacked on the shelves, one of the boxes collapsed, causing the toilet to strike the plaintiff's body. 

The plaintiff says he sustained significant and severe injuries, and that Home Depot was negligent in failing to exercise appropriate care in the stacking of the toilets at the store.

Calvin seeks between $200,000 and $1 million in monetary relief, exemplary damages, compensatory damages, court costs, interest and all other just relief. He is represented by attorney Adrian V. Villacorta of The Villacorta Law Firm PC in Houston.
