Consumer alleges Red Auto Protection telemarketers harassed him

BEAUMONT — A Collin County man is suing an auto industry company, alleging he was harassed by telemarketers.

Craig Cunningham filed a complaint July 22 in U.S. District Court for the Eastern District of Texas against Smithkey Auto Industries Inc., doing business as Red Auto Protection CarGuard Administration Inc., Elijah Norton, Trevor Smith and Nation Motor Club LLC, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, Cunningham began to receive a number of calls from the defendants, which were telemarketing calls, attempting to sell products. The plaintiff says he asked that the defendants stop calling but they failed to do so and continued to call Cunningham's personal residential number.

Cunningham seeks $3,000 per intentional call in statutory damages, $1,500 in statutory damages, interest, attorney fees, court costs and all other just and proper relief. He is representing himself.
