Patient alleges medical companies have failed to provide records

HOUSTON — A Harris County woman is suing a group of medical companies, alleging she has not been given her medical records.

Mary Myers filed a complaint Aug. 12 in Harris County District Court against U.S. Pain & Spine Hospital LP, U.S. Pain & Spine Institute LLC, USPS Healthcare LLC, USPS Surgical Institute GP LLC, PICIG Ltd., PICIG Management LLC, Dr. Phillip C. Phan, Waterway Medical Management LLC and Kent Olsan, alleging breach of statutory duty, breach of contract, conversion and fraud.

According to the complaint, Myers had a spinal cord stimulator device implanted Oct. 10, 2017, and has been trying to receive a copy of her medical records and imaging records. The defendants, however, despite her many requests, allegedly had not provided the information that she requested. The defendants allege they have none of the information that the plaintiff is requesting.

Myers seeks attorney fees, court costs, all equitable relief and interest. She is represented by attorneys Les Weisbrod, Luke Metzler and Kason Kimberley of Miller Weisbrod LLP in Dallas.
