Hempstead dog sanctuary owners accuse contractor of contract breach

HOUSTON —Two owners of a Hempstead dog sanctuary are suing a contractor, alleging a contract was breached.

Rick Laminack and Elaine Rosen filed a complaint Aug. 23 in Harris County District Court against RSFM Inc., alleging breach of contract, violation of Deceptive Trade Practices Act, negligence and breach of fiduciary duty.

According to the complaint, Laminack and Rosen are founders of the Dog Lodge Sanctuary in Hempstead. The suit alleges in May 2016, the plaintiffs entered into an agreement with RSFM in which the defendant agreed to design and build a metal frame building for the dogs. 

The plaintiffs allege they suffered economic damages, however, when the defendant failed to construct the building properly and fraudulently overcharged the plaintiffs with a bill of more than $220,000.

Laminack and Rosen seek damages of more than $1 million, economic relief, interest, attorney fees, court costs and all just relief. They are represented by attorneys Benjamin R.
