Customer Alleges Negligence Against Retail Giant Wal-Mart Over Slip-and-Fall Incident

A slip-and-fall incident at a major retail store has led to a lawsuit, drawing attention to the responsibilities of businesses in maintaining safe environments for their customers. America Boquin filed a complaint against Wal-Mart Stores Texas, LLC in the District Court of Harris County, Texas on November 15, 2024. The lawsuit stems from an alleged injury sustained by Boquin while shopping at one of the defendant's stores.

According to the court documents, America Boquin claims that she suffered personal injuries on October 24, 2024, when she slipped and fell due to a slippery substance on the floor of a Wal-Mart store located at 9460 W. Sam Houston Pkwy S, Houston, Texas. As an invitee on the premises, Boquin argues that Wal-Mart had a duty to ensure her safety by maintaining reasonably safe conditions within the store. The plaintiff asserts that Wal-Mart either created or failed to rectify the hazardous condition that led to her fall and subsequent injuries to her right knee, hip, and arm.

Boquin's legal filing accuses Wal-Mart of negligence and premises liability. The allegations include failing to maintain safe conditions in the aisles, neglecting to inspect and correct dangerous conditions, and not warning customers about potential hazards. "Defendant knew or should have known of the unreasonable dangerous condition," states the complaint, highlighting that Wal-Mart did not take necessary actions to prevent such incidents despite having control over its premises.

The plaintiff is seeking monetary relief ranging from $250,000 to $1 million for damages incurred due to medical expenses, pain and suffering, physical impairment and disfigurement, as well as lost wages and diminished earning capacity. Additionally, Boquin requests pre-judgment and post-judgment interest along with all applicable court costs.
