Former nursing director alleges Texas Health School failed to pay for overtime work

HOUSTON — A former nursing director who currently lives in Maryland is suing a health enterprise, alleging she was not paid for overtime work.

Diane Friend filed a complaint Aug. 26 in the Houston Division of the Southern District of Texas against Texas Health School LP, alleging violation of the Fair Labor Standards Act.

According to the complaint, Friend worked as nursing director for Texas Health School from January 2017 to January 2019. The suit alleges during the course of her employment, Friend worked in excess of 40 hours a week. The plaintiff says she also was regularly docked pay for absences and was never paid for the overtime she worked, in violation of FLSA.

Friend seeks liquidated damages, back overtime payments, interest, attorney fees court costs and all just relief. She is represented by attorney Shelly M. Davis-Smith of Houston.
