HOUSTON — A Woodlands couple is suing a certification corporation, alleging inaccurate information resulted in the flooding of their home.

Donald and Elizabeth Hickey filed a complaint Aug. 26 in Harris County District Court against All Points Services Corp and Jose Bauri, alleging negligence.

According to the complaint, the Hickeys own the property of 66 Lake Reverie Place. The Woodlands. The suit says they purchased an elevation certificate for a house that they contracted to purchase with Darling Homes on lot 17, block 1, section 17 of The Woodlands' Creekside Park west subdivision. The plaintiffs say were led to believe that based on the surveyor's elevation certificate that the home they were purchasing was at an elevation of 145.8 feet when it was really 144.3 feet.

As a result of the incorrect elevation of the property, the suit states, the plaintiffs' home was damaged due to Hurricane Harvey in August 2017, causing substantial damages to their property.

The Hickeys seek monetary relief of more than $1 million, attorney fees, court costs, interest and all other just relief. They are represented by attorneys Kenneth T. Fibich, of Fibich, Leebron, Copeland, Briggs in Houston, Muhammad S. Aziz of Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston, Annie McAdams of Annie McAdams PC in Houston, Larry G. Dunbar of Dunbar Harder PLLC in Houston and James E. Bradley of Bradley Law Firm in Houston.
