Tomball property owners allege contractor failed to properly repair roof

HOUSTON — A Tomball couple is suing a contractor, alleging their roof was repaired poorly.

James R. Luke and Genevieve Luke filed a complaint Aug. 27 in Harris County District Court against Diamond KK Inc., and Nationwide Property and Casualty Insurance Co., alleging violation of the Deceptive Trade Practices Act.

According to the complaint, on Aug. 13, 2005, the Lukes entered into an agreement with Diamond KK to repair their roof at 12606 Bounty Lane, Tomball. The suit states the plaintiffs found that the repair work was done poorly, causing the Lukes to suffer economic damages.

The Lukes seek monetary relief between $100,000 and $200,000, trial by jury, attorney fees, court costs, interest and all other just relief. They are represented by attorney G.P. Matherne of Spring.
