Target customer alleges negligence after iron rack fell on her

HOUSTON  — A Target customer alleges negligence after she says an iron rack fell on of her while she was shopping at a Harris County Target store. 

According to the Oct. 22 Harris County District Court complaint,  Ariane Daughtry accuses Target Corporation of premises liability and negligent activity.

The plaintiff alleges on May 23, 2018, while she was shopping at the Target store, a tall cast iron rack tipped over and fell on her. The suits state Daughtry sustained debilitating injuries to her right hand, right arm, right shoulder and her body. The plaintiff says this led to medical expenses, pain and suffering, physical impairment as well as disfigurement, mental anguish and lost wages. 

"The iron rack with a missing wheel created an unreasonably dangerous condition for plaintiff and other similarly situated shoppers," the suit alleges.  "[Target's] failure to use reasonable care in reducing or eliminating the risk of harm caused by the dangerous iron rack proximately caused [Daughtry] to suffer physical injuries and monetary damages."

Daughtry seeks monetary relief between $200,000 and $1 million, trial by jury and all other just relief. She is represented by attorney Kenneth Baird of The Baird Law Firm in Houston.
