Daughters allege Friendswood nursing center's negligence caused mother's death

GALVESTON — The daughters of a woman who sustained injuries and died after a fall at a Friendswood nursing center have filed a wrongful death suit, alleging the facility was negligent and contributed to their mother's death. 

According to the Oct. 23 Galveston County Circuit Court filing, Sandra De La Cruz, Kathleen Jones and Sharon Caldwell, on behalf of their deceased mother, Linnea Burch, are suing Friendship Haven Nursing Centers Ltd., et.al. 

According to the complaint, Burch was recovering from surgery at Friendship's nursing facility in October 2017 when she fell on the floor of her room. She was then taken to Memorial Hermann South Hospital for treatment for her injuries but died Jan. 2, 2018, the suit states. 

"Defendant and its staff were negligent in their care, treatment and failure to properly use medical apparatus resulting and ultimately causing the injuries and death of the decedent," the plaintiffs allege in their suit.  "This negligence includes failing to respond to decedent's high-risk fall status and [failure to] implement the appropriate precautions, failing to adequately monitor decedent's activities in order to provide continuity of care and failing to monitor decedent both before and after her fall."

De La Cruz, Jones and Caldwell seek actual, general and special damages, plus interest, court costs and all other just relief. They are represented by attorney Michael Davis Robert D. Clements Jr, of Robert D. Clements Jr. Law Group LLLP of Alvin.
