Houston customer alleges Fisher Homes failed to honor construction warranty

HOUSTON — A Houston man is suing Fisher Homes, alleging the defendant failed to honor the warranty on his home, which he alleges sustained numerous construction defects.

According to the Oct. 21 Harris County District Court filing, Philips Iheme accuses Kavac LLC, doing business as Fisher Homes, and Terry Fisher, doing business as Fisher Homes of Texas, of negligence, gross negligence and breach of express warranty.

The suit alleges Iheme purchased the Holly Street home in June 2018 and the property suffers from separated trim/stucco, frame damage, interior leaks, failing rooftop terrace, elevated moisture and damage to structural beams and the floors.  

"Plaintiff notified defendants that the residence suffered from severe issues, but [the] defendants failed and/or refused to address these issues and/or otherwise honor their warranty," Iheme alleges. "These issues have led to other damages due to the defendants' failures."  

Iheme seeks between monetary relief  between $100,000 and $200,000, actual and exemplary damages, interest and litigation costs. He is represented by attorney Karalynn Cromeens and Kelly Stamy of Cromeens Law Firm PLLC in Houston.
