Tenant Amy Coquyt sues Apartment Owners for Negligence Leading to Injury

Amy Coquyt has filed a lawsuit against Highland Apartments and LSC Highland Owner II LLC, alleging negligence in maintaining safe premises that resulted in her personal injury. The complaint was lodged on November 21, 2024, in the District Court of Harris County, Texas. Coquyt claims that the defendants failed to address hazardous conditions at their property, leading to her fall and subsequent injuries.

According to the court documents, Amy Coquyt, a resident of Texas, was injured on January 3, 2024, while descending a staircase at Highland Apartments located at 6969 Hollister Rd., Houston. The lawsuit details that the staircase had deteriorated due to rusted bolts and damaged concrete steps, which posed an unreasonable risk of harm. Coquyt asserts that as a tenant of the defendants' property, she relied on them for maintenance and safety of common areas such as staircases. "Defendants owed Plaintiff a duty to keep the common areas of the apartment complex safe for tenants," states the complaint.

The plaintiff accuses Highland Apartments and LSC Highland Owner II LLC of multiple breaches including failure to repair or warn about the dangerous condition of the premises. She argues that these failures amount to negligence under premises liability law. The complaint highlights that Defendants were aware or should have been aware of the hazardous condition due to their control over property maintenance and prior attempts or agreements to repair it.

Coquyt is seeking damages exceeding $250,000 but not more than $1 million for medical expenses incurred and anticipated future costs related to her injuries. She also claims compensation for loss of household services and support she could no longer provide due to her injuries. Additionally, she seeks redress for physical pain, mental anguish suffered both past and future, physical impairment experienced now and expected in future, as well as loss of earning capacity.
