Potbelly customer alleges BMW was damaged in parking lot by HVAC mechanic

HOUSTON — A Houston man alleges his BMW was significantly damaged in the parking lot of a Potbelly restaurant by a mechanic who was fixing the restaurant's HVAC/air filtration system. 

Samir Becic filed a complaint Oct. 28 in Harris County District Court against Woodlands Mechanical Group, LLC and Potbelly Sandwich Works LLC, alleging negligence. 

According to the complaint, on June 14, 2018, Becic parked his BMW in the parking lot of the Potbelly restaurant, 1141-05 Uptown Park Blvd., Houston. when a Woodlands Mechanical employee working on Potbelly's air conditioning system damaged the plaintiff's car. 

The plaintiff alleges the damage has devalued his BMW, cost Becic repair expenses, and the use of his car. The suit states the defendants had an obligation "to exercise ordinary care to keep the premises in reasonably safe condition."

Becic seeks monetary damages between $200,000 and $1 million, trial by jury, interest, litigation costs and all other just relief. He is represented by attorney Tommy Servos of The Servos Law Firm PLLC in Houston.
