Woman's suit alleges that San Antonio firm violated Fair Debt Collection Practices Act

HOUSTON  — A San Antonio-based law firm working in debt-collection practices is facing a lawsuit by a 63-year old woman alleging the firm's collection letter is misleading and violates the Fair Debt Collection Practices Act (FDCPA). 

Candy Stormer filed her complaint on Oct. 28 in the Houston Division of the Southern District of Texas against Jonathan Fly, a professional law corporation. The lawsuit claims that Stormer received a debt collection from the defendants on Sept. 4, 2019 and alleges that the "itemization of 'other unpaid obligations' misled and deceived the plaintiff into believing if she did not promptly address the subject debt with the defendant, she could be subjected to further illusory charges, even though such charges could not lawfully come to pass."

Stormer seeks monetary relief, trial by jury, punitive damages and other just relief. She is represented by Nathan Volheim and Taxiarchis Hatzidimitriadis of the Sulaiman Law Group Ltd. in Lombard, Illinois.
