Texas woman's lawsuit claims debt collector harassed her and others over student loans

LUFKIN — A Texas woman is claiming a third-party debt-collection agency "bombarded" her with student loan debt-collection calls on her cell phone as well as called her husband and his former wife in attempts to collect. 

Misty Delaney filed a complaint ON Oct. 29 in the Lufkin Division of the Eastern District of Texas against Valentine & Kebartas, LLC, alleging violation of the Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA) and the Texas Debt Collection Act (TDCA).

Delaney claims she began receiving debt-collection calls on her cell phone from the defendants in September 2019 regarding the student loan she obtained while attending Northwestern University. She claims her husband and his ex-wife also received calls regarding Delaney's student-loan debt. 


"The defendant intentionally harassed and abused the plaintiff on numerous occasions by calling multiple times in one day, and on back-to-back days, with such frequency as can be reasonably expected to harass," Delaney claims in her suit. 

Delaney seeks monetary and injunctive relief, trial by jury, punitive damages and all other just relief. She is represented by Alexander Taylor, Marwan Daher and Omar Sulaiman of the Sulaiman Law Group Ltd. in Lombard, Illinois.
