Load Trial faces allegations of not paying its landscapers for overtime

DALLAS — Load Trail is facing allegations by two former employees who worked as welders who claim they were not paid for overtime work. 

Juan Barrios and Jose Hernandez filed a complaint Nov. 7 in the Sherman Division of the Eastern District of Texas against Load Trail, LLC alleging violation of federal wage law. 

The plaintiffs worked for Load Trail for several years until August 28, 2018 and were paid on a "piece rate basis," according to the suit. They allege that they worked in excess of 40 hours per week and were not compensated for overtime. 

Barrios and Hernandez seek monetary relief, trial by jury and other just relief. They are represented by Matthew Scott, Javier Perez of The Scott Perez Law Firm LLP in Dallas adn Nicanor Pesina, Jr of The Roberts & Roberts Law Firm PC in Tyler.
