Motorcyclist thrown from bike blames pothole in lawsuit against DOT

GALVESTON — The Texas Department of Transportation (DOT) is facing a negligence suit filed by a man who claims he was thrown from his motorcycle on Highway 3 after hitting a large pothole. 

Damon Matthews filed a complaint on Nov. 4 in the Galveston County District Court against the DOT, alleging premises liability negligence. According to the suit, Matthews was riding on Highway 3 and attempting to enter onto Interstate 45 when he struck a "sizeable hole or pothole" in the road that caused him to be ejected from his bike. As a result of the accident, Matthews' lawsuit claims, he suffered severe injuries.

Matthews seeks monetary relief between $200,000 and $1 million, interest and all other just relief. He is represented by J.W. Stringer in Houston.
