Oilfield services worker alleges Total Safety did not pay overtime

HOUSTON — A Montgomery man who worked as an oilfield services safety technician alleges Total Safety did not compensate him for overtime in violation of the Fair Labor Standards Act (FLSA).

Michael Gerstmann filed a complaint Nov. 13 in the Houston Division for the Southern District of Texas against Total Safety U.S. Inc., alleging violation of the FLSA.

Gerstmann says he as a safety technician for Total Safety from February 2017 through June 2019. According to the complaint he was paid at an hourly rate and was required to stay at a worksite for "several consecutive 24-hour periods" and was not compensated for overtime. He alleges Total Safety "knew or reasonably should have known that" he was "not exempt from overtime provisions of the FLSA."

Gerstmann seeks monetary relief, trial by jury, interest and all other just relief. He is represented by attorney J. Forester of The Forester Haynie Law Firm PLLC in Dallas.
