HOUSTON — Energi Pros faces a suit alleging it violated federal law by failing to pay overtime and fired an employee after illegally obtaining his consumer report and background check.
Raymond Chappie, individually and for others similarly situated, filed a class action complaint Nov. 13 in the Houston Division of the Southern District of Texas against Energi Pros LLC, alleging violation of the Fair Labor Standards Act (FLSA) and FCRA.
According to the complaint, Chappie worked for Energi Pros as a green energy technology specialist in Houston from July 1-Aug. 21. He alleges he and others worked more than 40 hours per week without overtime compensation as required by FLSA. He also alleges Energi Pros conducted background checks using a non-FCRA compliant outside consumer reporting agency and was fired because of his report.
Chappie seeks monetary relief, civil penalties for Energi Pros, trial by jury and all other just relief. He is represented by attorneys Charles Branham III of The Dean Omar Branham Law Firm in Dallas and Jason Brown, Nicholas Conlon and Lotus Cannon of The Brown Law Firm LLC in Jersey City.
