Gold's Gym membership leads to charges of harassing debt collection calls

HOUSTON — A Utah law firm faces a suit from a Humble woman who alleges she received harassing calls regarding a Gold's Gym membership that was already canceled.

Jennifer Rivas filed a complaint  Dec. 16 in the Houston Division of the Southern District of Texas against Aldous & Associates PLLC, alleging violation of the Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA) and Texas Debt Collection Act (TDCA). 

In her complaint Rivas alleges on or before Oct. 2, she began to receive "prerecorded voicemail messages" from Aldous & Associates regarding collection on her Gold's Gym membership that she had canceled in 2018. Rivas says she told the defendant's representative that she owed nothing to Gold's and requested they stop calling. 

On Oct. 7, the suit states, Gold's had negatively reported on Rivas' credit report which was deleted Oct. 11. The plaintiff alleges she continued to receive unsolicited calls from Aldous & Associates.

Rivas seeks monetary relief of at least $500 in statutory damages for each violation, treble damages of up to $1,500 for each violation, trial by jury, interest, attonrey fees and all other just and proper relief.
