Former Premium Retail Services employees claim commissions were not factored into their overtime pay

TEXARKANA — Premium Retail Services is facing a complaint alleging they failed to include employee commissions in calculating overtime pay. 

Demarrio Robinson and Mickina Wimbley, each individually and on behalf of all others similarly situated filed a complaint Feb. 20 in the U.S. District Court for the Eastern District of Texas Texarkana Division against Premium Retail Services Inc., alleging violation of the Fair Labor Standards Act.

The plaintiffs worked at Premium Retail stores as hourly-paid employees who also received commissions.  They allege that they received overtime wages for working more than 40 hours per week. The plaintiffs claim that their overtime wages did not include commissions that were paid in their regular rates when calculating overtime pay in violation of federal law. 

The plaintiffs seek monetary relief, interest and all other proper relief. They are represented by Josh Sanford of The Sanford Law Firm PLLC in Little Rock, Arkansas.
