HOUSTON — A Texas woman who purchased a ticket to the Houston Rodeo has filed a class-action suit against an online ticket seller, claiming the seller violated its purchase agreement by not refunding ticket holders after event cancellations due to the COVID-19 pandemic.
Bonita Fils, on behalf of herself and all others similarly situated, filed a complaint June 17 in the Houston Division of the Southern District of Texas against Internet Referral Services LLC, alleging breach of contract, unjust enrichment and other claims.
Fils claims she purchased a ticket for the Houston Rodeo on Jan. 16, 2020, from www.tickets-center.com, to see country singer Chris Stapleton perform on March 19. She alleges the purchase agreement included a "complete refund" if the event was canceled and could not be rescheduled.
Fils claims that on March 11 she received an email from the defendant stating that the event had been cancelled due to the COVID-19 pandemic and that a refund would be sent to her account within two to four weeks.
Fils claims that, as of May 18 she had not received the refund and that Internet Referral Services had changed its refund policy without notice and refuses to provide refunds.
The plaintiffs seek monetary relief, trial by jury, interest and all other appropriate relief.
