The COVID-19 pandemic presents legal challenges and emerging risks to businesses ranging from essential industries, such as grocery stores, restaurants and big box stores, to those categorized as nonessential, such as hotels, theme parks, gyms and hair salons. Many have begun using liability waivers or disclaimers to warn customers about the possible risk of exposure to COVID-19 in their places of business. While the use of a legal waiver or release may in certain instances effectively preclude third-party liability claims, there are numerous scenarios where they may not be enforceable as a valid protection from COVID-19-related lawsuits. A much broader and more comprehensive risk mitigation approach must therefore be adopted and consistently implemented to meet the risks presented when operating a business in the midst of a pandemic.
