Forklift operator claims injuries after truck driver suddenly pulled away from loading dock

HOUSTON — A Houston warehouse forklift operator claims she was thrown out of the back of a tractor trailer when the driver suddenly pulled away from the loading dock. 

Laura Toliver filed a complaint  Feb. 25 in Harris County District Court against Kingzland Trucking Co., LLC, Kingzland Brokering Inc., Muslim Owens and Albert Thomas alleging negligence. 

According to Toliver's complaint, On Sept. 30, 2019, Thomas had parked Kingzland's freightliner, which had an attached trailer, at the Keller Warehouse loading dock in Houston at around 4 a.m. She alleges that while the trailer was parked, she was operating a forklift in the back of the trailer when Thomas suddenly and "without warning" pulled the tractor trailer away from the loading dock. 

Toliver claims she was ejected from the rear open door of the trailer and suffered "significant" bodily injuries. She alleges the defendants' negligence for failing to keep a proper lookout, failing to supervise and properly train its employees and failing to have safety polices and procedures for the safe operation of the tractor trailer. Toliver also alleges Kingzland failed to hire a "reasonably safe driver" to operate its tractor trailer. 

Toliver seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Michael Callahan of Casey Brown in Houston.
