Rig worker allegedly struck by 400 pound cross over sub, sues XTO Energy

HOUSTON — A Houston rig worker is claiming negligence after being struck by a 400 pound piece of drilling equipment and suffering injuries. 

Joseph Edwards filed a complaint Feb. 25 in Harris County District Court against XTO Energy Inc., doing business as XTO Energy Partners Operating LLC alleging premises liability and negligence. 

Edwards was working for Ensign Energy at its Rig located in Barstow on April 25, 2019, with XTO serving as the general contractor on the job site, according to his complaint. He alleges that he suffered injuries to his leg, foot and other parts of his body when he was struck by an approximately 400 pound cross over sub that was released from the iron roughneck. 

Edwards claims the defendants were in control of the safety on the premises and failed to have or enforce a safety plan and supervise the job site. He further alleges the defendants were negligent for failing to provide safe cross over sub supports and neglected to inspect or test the cross over sub safety system and were in violation of several OSHA standards. 

Edwards seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Maxey Scherr of Scherr & Legate PLLC in El Paso.
