Drunk driver struck man in parking lot of Houston sports bar, suit alleges

HOUSTON — A man who was struck by an intoxicated driver while walking in the parking lot of a Houston sports bar is claiming negligence. 

Christopher Martinez and Rene Leal filed a complaint March 16 in Harris County District Court against Ojos Locos Sports Cantina Houston III, and John Doe alleging negligence. 

According to Martinez's complaint, he and Rene Leal were at Ojos Locos Sports Cantina on Southwest Freeway in Houston on March 1, 2021. They allege that they were sitting near the front door when Doe, who was "intoxicated and rowdy" struck an individual directly in front of the table where they were sitting. 

The plaintiffs allege that while leaving the premises and walking to their vehicle in the parking lot, Doe struck a couple of vehicles with his truck and then struck Martinez. They further allege Martinez suffered "serious and permanent" injuries. 

The plaintiffs claim in their suit that Ojos Locos was negligent in continuing to serve Doe alcoholic beverages when it was apparent he was intoxicated and "presented a clear danger." 

The plaintiffs seek monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by Douglas Peterson, Adam Anthony and Brett Anthony of Anthony Peterson LLP in Corpus Christi.
