HOUSTON — The estate of a woman whose father worked with asbestos claims she contracted mesothelioma through exposure and handling of her father's clothing.

Robert Weist, individually and as personal representative of the Estate of Kathy Lynn Weist, deceased filed a complaint March 29 in Harris County District Court against Santa Fe Braun Inc., et al alleging wrongful death, negligence, misrepresentation and fraud.

According to the plaintiff's complaint, Kathy Weist's father worked "extensively" with asbestos from 1957 through 1977. He alleges that the clothing of Kathy Weist's father was contaminated with asbestos dust and that she was exposed to "large quantities" of the asbestos while handling and washing her father's clothes. The plaintiff claims that due to Kathy Weist's exposure to the asbestos, she developed mesothelioma which resulted in her death.

The plaintiff also claims the defendants knew or should have known that their asbestos-containing products and the machinery they manufactured and sold was dangerous. He alleges the defendants were also negligent in making "representations" and "implied to workers and users of its products" that asbestos containing products were safe and "would not cause injury."

The plaintiff seeks monetary relief, trial by jury and all other just relief. He is represented by Daniel Wasserberg of Meirowitz & Wasserberg LLP in New York City.
