HOUSTON — A worker claims he suffered damage to his lungs after exposure to contaminated fuel being transferred into a tank at Dalhart Municipal Airport.

Jerry Thomas filed a complaint March 29 in Harris County District Court against United Petroleum Transports Inc., and Gregmar Inc., alleging negligence.

According to Thomas' complaint, an United Petroleum Transports Driver hit a 7,800-gallon tank that caused damage to a 14,000-gallon fuel tank at Larsen Aviation located at the Dalhart Municipal Airport.

Thomas alleges that United Petroleum Transports brought "contaminated fuel" to Larsen Aviation and did not have the proper coupling to transfer the fuel to a temporary tank. He further alleges that during the transferring of the contaminated fuel, it vaporized into an aerosol and caused him to breathe poisonous fumes. Thomas claims he inhaled toxic chemicals that resulted in "respiratory impairment" as well as lung damage and that he began to vomit and had to be taken by ambulance to the emergency room.

He alleges United Petroleum Transports' negligence for failing to properly transfer the hazardous chemicals and failed to warn him of the hazardous chemicals and gases.

Thomas seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Attorneys Dean Boyd and Blake Scott in Amarillo.
