Suit alleges worker was crushed by box being moved on forklift

HOUSTON — Two companies are facing a suit after a worker was crushed by a box that was being moved by a forklift at one of the Texas job sites.  

Billy Davis filed a complaint April 5 in Harris County District Court against Liberty Oilfield Services LLC and Fila-Mar Energy Services LLC alleging negligence. 

According to his complaint, Davis was employed by a third-party while working at a job site under the control of the defendants on Aug. 2, 2020. He alleges that he was standing in the vicinity where one of the defendants' employees was moving a "shift-box" with a forklift. Davis claims the employee failed to "safely and properly" move the box which caused him to be crushed by the box and suffer "multiple substantial injuries." 

He alleges the defendants' employee failed to maintain a proper lookout while operating the forklift and failed to use the forklift in a safe manner. He also alleges the defendants failed to supervise and train their employees and that they were negligently maintaining their job site. In addition to his pain and suffering, Davis claims he has also faced disability, loss of income, mental anguish and has incurred medical, hospital and pharmaceutical expenses.

Davis seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by John Caston and Michael Tilton of Tilton & Tilton LLP in Houston.
